MANAGEMENT AND MAINTENANCE OF THE EXISTING RELATIONSHIP WITH OUR CUSTOMERS, suppliers, collaborators, users of our website, supplier/customer service, processing managers, control and management of the relationship with employees, access control, video surveillance of the company’s facilities, marketing and communication, personnel selection, followers in RRSS of OC ARQUITECTOS.
WHAT PERSONAL DATA WE PROCESS:
merely identifying data (name + surname) and contact data where applicable (address, telephone and email address), data required for the drafting of necessary contracts (events) or to access specific services, C. Vitae received by email, data provided at events or presentation acts of OC ARQUITECTOS, data provided in the profiles on social networks of which OC ARQUITECTOS is the owner, training activities managed by the company for employees, suppliers and customers, events, promotional activities or similar.
When filling in any of our forms/sections/communication channels, you are allowed to provide, among others, the following personal data:
- Your first and last name and contact details (address, telephone numbers and email), and a space for free text.
- Other contact details and preferences, your user IP, time, browser, etc.
- When you visit our website we will collect your data, if you fill in any of our current or future data/contact forms, information requests or newsletter subscriptions.
- If the personal data have been provided by users, they must be truthful, and OC ARQUITECTOS must be notified of any changes that occur in them, responding in any case of the truthfulness and accuracy of the data provided at all times.
- The interested party who provides his or her personal data to OC ARQUITECTOS declares that he or she is of legal age and is entirely responsible for this declaration.
Other treatments
- Sending commercial advertising communications by email, SMS, Wasap, social networks or any other electronic or physical means, present or future, that enable commercial communications. These communications will be made by the RESPONSIBLE and related to our Company or about our computer programming services, as well as events and activities organised by OC ARQUITECTOS.
- Actions requested by the User: To process requests or any type of request that, through the Web of OC ARCHITECTS, is made by the user / client through any of the forms of contact that are made available, or by subscribing to our events and activities organized by / with the participation of OC ARCHITECTS.
- To process registrations for events and PROMOTIONAL EVENTS in which customers or registrants wish to participate. In this case, the images or videos made of the participants in particular during the development of the same, and provided that express and unequivocal consent has been obtained, may be published on the website of the entity, in its social networks, in publications and corporate brochures, noticeboards and any other similar media owned by OC ARQUITECTOS, in order to promote such activities or events. In the event of promotional or similar activities, the data of the participants (name, surname and age) may be published in the same media, in order to publicise the participation or results of the activities. In the event that this data processing is not expressly consented to, these will only be known internally by the participants, as a necessary requirement for the correct development of the same (legitimate interest).
- DATA STORED DURING YOUR VISIT: When you visit our website, our web servers generally store, among other things, information about the browser and operating system you use, the website from which you visit us, the pages you visit on our website and the date of your visit. For security reasons – for example, in order to be able to detect possible attacks on our website – the IP address assigned to you by your Internet service provider is also stored for a period of seven days. With the exception of the IP address, personal data is only stored if you provide us with this information, e.g. in connection with a registration, survey, request for quotation, user registration, commercial promotion. OC ARCHITECTS uses your personal data for the technical administration of the websites, customer management, carrying out surveys and for marketing purposes only to the extent necessary and only if the user and owner of the data has been informed in advance.
- NEWSLETTER/NEWSLETTERS SUBSCRIPTION: In the case of subscription to any of our informative Newsletters, present or future, as reported, you consent to the use of your personal data for sending advertising or carrying out other marketing actions, these will be stored and used continuously for such uses, such as sending newsletters already mentioned, about our Company or about our consulting services and computer programming, as well as events and activities organized by OC ARCHITECTS, through communication channels such as e-mail, postal mail or any other channel authorized by you. We may use your data to create and keep your customer/supplier, employee or user profile up to date in order to send you personalised information. We may also use the information you provide to analyse and improve the effectiveness of our website services, advertising and marketing.
- SENDING C.VITAE BY CANDIDATES: We process and analyse the documents provided as CVs, either in person (you must provide your express consent) or through the addresses provided on our website.
The legal basis for this is your consent to receive the newsletter in accordance with Art. 6 (1) a) GDPR. You can revoke your consent to receive the newsletter at any time via the unsubscribe link in the newsletter. Through these forms, the applicant authorises OC ARQUITECTOS to analyse the documents sent to him/her, all content directly accessible through search engines (Google), the profiles he/she maintains on professional social networks, such as Linkedin or similar, the data obtained in the entrance tests and the information he/she discloses in the job interview, with the aim of assessing his/her candidacy and being able, if necessary, to offer him/her a position, at OC ARQUITECTOS, requesting his/her express consent to do so. In the event that the candidate is not selected, OC ARQUITECTOS may keep stored your C. VITAE to incorporate it into future calls, unless the candidate states otherwise.
DATA RETENTION CRITERIA:
The data provided will, in general, be kept for as long as there is a mutual interest in maintaining the purpose of the processing and when it is no longer necessary for that purpose, it will be deleted with appropriate security measures to ensure the pseudonymisation of the data or the total destruction of the data.
In view of this general rule, the following possible variations arise:
- (i) Aggregated data: will be retained without a deletion period.
- (ii) Data of users, companies and suppliers, etc… OC ARCHITECTS: retention period of 4 years (Art. 66 and following of the General Tax Law), retention period of 6 years 30 of the Commercial Code on accounting books and invoices).
- (iii) Data supplied when subscribing to our newsletter: from the time the User gives his/her consent until he/she withdraws it.
- (iv) Documentation of an employment or social security nature: 4 years Article 21 of Royal Legislative Decree 5/2000, of 4 August, approving the revised text of the Law on Infractions and Penalties in the Social Order, (v) data supplied by candidates by sending their C.Vitae: the C.Vitae may be kept for a maximum of two years for future selection processes unless the candidate states otherwise.
- (v) Video surveillance images: Instruction 1/2006, article 6, in relation to the time limits for the conservation of images, which remains at 30 days.
- (vi) Complaints Channel: 3 months in accordance with Law 2/2023 regulating the Channel.
Communication of data:
Your personal data may be communicated to:
- Companies and entities and other organisations to which the provision of services has been contracted, such as: hosting, marketing services, contracted cloud services, market analysis and information society services.
- Collaborating companies/sponsors with which OC ARQUITECTOS has reached a collaboration or sponsorship agreement.
- Companies or other organisations to whom you have asked us or agreed that we may share your personal data.
- Existence of subcontractors: For certain internal activities/processes of OC ARCHITECTS, subcontractors are required to provide specific services. These subcontractors can be external suppliers both inside and outside the EU. - Providers of professional services, such as lawyers, solicitors, arbitrators, notaries, registrars or other similar professionals in certain cases.
- Public bodies, courts, courts, regulators and other administrative authorities, where we believe it is necessary to comply with a legal or regulatory obligation, or otherwise to protect against claims against us or third parties, or the safety of individuals, as well as to prevent, or otherwise combat, fraud or for safety or security reasons.
- Any third party who purchases, or to whom we transfer, all or substantially all of our assets and business. In the event of such a sale or transfer, we will use reasonable efforts to try to ensure that the entity to which we transfer your personal data will use it in accordance with this Privacy Policy.
Data will be processed on the legal basis of the express consent of the person providing the data. Such consent may be withdrawn at any time, although this will not affect the lawfulness of any processing previously carried out. The provision of the data is voluntary, although, in the event of failure to do so, the data may not be processed for the purposes indicated. SECURITY MEASURES:
In accordance with the provisions of current regulations on personal data protection, and in particular Regulation (EU) 2016/679 of 27 April 2016, and the LOPD-GDD 3/2018 for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the RGPD, whereby they are processed lawfully, fairly and transparently in relation to the data subject and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
In any case, OC ARQUITECTOS has implemented sufficient mechanisms to:
Ensure the continued confidentiality, integrity, availability and resilience of processing systems and services.
- Restore availability and access to personal data quickly in the event of a physical or technical incident.
- Regularly verify, evaluate and assess the effectiveness of the technical and organisational measures implemented to ensure the security of the processing.

OC ARQUITECTOS guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR 679/2016 and the LOPD-GDD 3/2018 in order to protect the rights and freedoms of Users and has communicated to them the appropriate information so that they can exercise them. OC ARQUITECTOS has installed all the technical means and measures at its disposal to prevent the loss, misuse, alteration, unauthorised access and theft of the Personal Data provided by the owner to OC ARQUITECTOS. However, the User must be aware that security measures on the Internet are not impregnable.
The personal data that is incorporated into the Internal Processing Activities Registry will be treated with the utmost confidentiality and security. The Owner may send you commercial information regarding NEWS and INNOVATIONS about our Company or about our consulting and computer programming services, as well as events and activities organized by OC ARQUITECTOS. In this case, the sender undertakes to indicate its advertising purpose when sending it, and to coordinate a simple, clear and free system in case you wish to stop receiving it.
The computer programming and consulting services offered by OC ARQUITECTOS, and whose description is contained on the website for, where appropriate, requesting information, are intended exclusively for adults. In the event that OC ARQUITECTOS offers in the future any remote programming/assistance service or online download product/software, information on registration or participation in a promotional activity, event or similar, in which the collection of Personal Data of minors may occur, OC ARQUITECTOS will always request parental consent so that minors can access them and their Personal Data can be subject to automated processing as provided in this notice on the Data Protection Policy.
